Terms of Service

Please read these Terms of Service ("Terms") before using Guess What's Up? operated by Brown Consulting LLC ("we," "us," or "our"). By using the app or website, you agree to these Terms. If you do not agree, do not use Guess What's Up?

1. The service

Guess What's Up? is an iOS party guessing game. Players choose a deck, hold the phone on their forehead, guess prompts based on clues from other players, and use tilt gestures to mark cards correct or passed. The app may include Kids and Adults audience modes, local scoreboards, configurable round lengths, sound effects, and other gameplay features.

Features, decks, card counts, scoring behavior, and availability may change as we improve the game.

2. Safe and appropriate use

You agree to use the game responsibly. You should not:

• Play while driving, walking in unsafe areas, or doing anything that needs attention.
• Make sudden or forceful head movements that could cause injury.
• Use the app in a way that harasses, threatens, or harms other people.
• Use the app in violation of any applicable law or venue rule.

Adults are responsible for supervising children who use the app and for choosing decks appropriate for the group.

3. No account required

Guess What's Up? currently does not require an account. Optional player or team names and scoreboard results are stored locally on the device. You are responsible for the names and information you choose to enter into the app.

4. App Store and TestFlight

If you install Guess What's Up? through TestFlight or the Apple App Store, Apple's terms, privacy practices, and platform rules also apply. Apple is not responsible for the app, its content, maintenance, support, or any claims related to your use of the app.

5. Purchases

The app may be free during testing or early release. If paid features, subscriptions, or in-app purchases are added later, prices and billing terms will be shown in the App Store purchase flow before you are charged. App Store purchases, renewals, refunds, and cancellations are handled by Apple under Apple's terms.

6. Content and third-party names

Guess What's Up? may include card prompts that refer to public titles, broad pop-culture topics, game titles, songs, artists, movies, shows, foods, places, and common concepts for gameplay purposes. Third-party names, titles, and marks belong to their respective owners. Guess What's Up? is not sponsored by, endorsed by, or affiliated with those owners unless expressly stated.

You may not copy, scrape, redistribute, sell, or use the card libraries, app design, code, branding, or other materials except as allowed by the app itself.

7. Intellectual property

The Guess What's Up? app, website, design, branding, code, original text, sounds, and related materials are owned by Brown Consulting LLC or its licensors. These Terms do not give you any right to use our name, branding, source code, or proprietary materials outside normal personal use of the app.

8. Feedback

If you send us suggestions, bug reports, deck ideas, or other feedback, you allow us to use that feedback without restriction or compensation. You should not send anything you do not have permission to share.

9. Disclaimers

Guess What's Up? is provided "as is" and "as available." We do not promise that the app will be uninterrupted, error-free, compatible with every device, or perfectly accurate in scoring every motion. Gameplay may depend on device sensors, how the phone is held, and player movement.

10. Limitation of liability

To the maximum extent permitted by law, Brown Consulting LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, device issues, personal injury, or disputes arising from use of the app or website.

11. Termination

We may suspend or discontinue the app, website, beta access, or any feature at any time. You may stop using the app at any time and delete it from your device.

12. Privacy

Please review our Privacy Policy to understand what information the app stores locally and what limited information we may receive.
